Facts

Appellant was charged and convicted of the murder. He had apparently killed a 67 year old woman and three children. He made a confessional statement claiming that the deceased persons had bewitched him and killed his junior brother.

He was convicted with the trial court stating that the defence of mental delusion could not avail the appellant.

Appellant appealed to the Court of Appeal which dismissed the appeal and appealed further to the Supreme Court.
